On November 3, 2020, Florida voters approved Amendment 2 to the Florida Constitution which gradually increases the Florida minimum wage each September 30th until it reaches $15.00 an hour in 2026.
The first scheduled increase goes into effect September 30, 2021 and raises the Florida minimum wage to $10.00 an hour, with a minimum wage of at least $6.98 per hour for tipped employees.
This is a big change for Florida businesses because increases to the state minimum wage are usually smaller and happen only in January.
ALL employees must be paid at least the state minimum wage, including tipped employees (like food servers), but employers can take a tip credit of $3.02 per hour towards the minimum wage obligation for their tipped employees. Effective September 30th, the minimum cash wage an employer must pay a tipped employee is $6.98 per hour. If the employee’s tips plus this cash wage is less than $10.00 an hour, employers must pay the employee the difference.
Florida businesses are required to post a Florida-specific minimum wage poster at their business where employees can see it, even if all employees are paid more than the minimum wage.
